Full Version: Non-compete agreement

Anyone have a non-compete agreement I can take a look at. I'm thinking about hiring, however, I don't want to hire in my future competition. Thanks in advance.

Unless you have a patented process, most all will not hold up in court. Some do if you limit geographic area and put a time frame on it.

Dude... just spend the dough.... Hire a professional to draft one up for you..

Just keep in mind.....at the end of the day you can't keep a dude from making a living.. It doesn't matter how much paperwork you have...

UTMOST
If you do it correctly they hold up in court. Smart move and good luck. At the end of the day you can keep someone you trained and gave a place to groom their craft from taking food off your table.

i know they hold up in the dent business but i heard they dont in the tint world dunno.gif
TTS
The dent business uses 'corporate espionage' to prevent their trainees from digging directly into their business... but you can't keep a man from his or her trade..

You can keep them from using privilaged information (contacts at car dealerships, pricing strategies, marketing tactics, etc...).. but not from making a living...

This is where a good attorney will come in handy to help you with your situation specific to your area.

The first company I worked with when i was learning tried to get me to sign one, apparantly in ontario, it is supposedly !llegal to make someone sign one. My wife works for a lawyer and he told me sign it or dont sign it, it doesnt matter either way, noone can do anything about it! So i didnt sign and it was never brought up again. I left cuz they didnt pay well.... so pay your guy what he deserves and you wont have to worry about them taking your business away from you.
tintshopky
thanks for suggestions. may not hold up in court, but, gotta be better than not doing it. at least the trainee may remember signing it and make decisions because of it.
Matthew
pay them well or they wont think twice about leaving treat them right if their treating you right and dont get greedy

which type of pay scale works great for the installer and shop owner. commission based? per unit? i want what's best for the installer but, don't want to cut my own throat. any suggestions?
FilmBlazer
I say they are a good idea no matter what. I pay my installer hourly but he is a student and this is not his "career". I take very good care of him with bonuses, meals golf etc. thumb.gif

They are upheld in Ohio, as long as it's reasonable and you actually have a lawyer write it up thumb.gif

I had a employee sign one and it did hold up and court...he was told to cease tinting within 100 miles of me for 10 yrs as written in the contract. I had aslo signed one when i started my business 22 yrs ago and I just moved 100 miles away i wasn't tryng to compete against the lady i worked for .

Good Idea I wouldnt mind seeing a draft of one myself.

For now we see through a glass, darkly; but then face to face:
now I know in part; but then shall I know even as also I am known.
