who is responsible for uninspected tint

32% is the bottom limit. Spec is 35%. So they are already giving almost 9% for instrument, tint, and testing variation. -
I bought a vehicle from a dealer in NC that came from FL. FL tint is 28%, NC is 35%. It was inspected prior to the sale and the tint was not inspected. Measurement by a tint dealer reads 31.2% - out of spec of 32%. Now I must replace it. Is there any liability for the inspection station?
